Terms of Service

These Terms of Service ("Terms") govern your access to and use of websites, RSVP and ticketing flows, and related services operated by TONE Presents("TONE," "we," "us," or "our"), including tonepresents.com(the "Services").
By accessing or using the Services, submitting an RSVP, purchasing a ticket, or providing a phone number for SMS, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old to use the Services. Where alcohol is served or event rules require it, you must be 21+ and present valid government-issued ID at entry. We may refuse service or entry if eligibility or ID requirements are not met.
2. Events, RSVPs & Tickets
- RSVP approval, guest-list placement, and ticket issuance are subject to capacity, venue policies, and our discretion. Submission of an RSVP does not guarantee entry until confirmed and (if required) paid.
- QR codes and ticket links are personal. Sharing, reselling, or duplicating tickets without our permission may result in cancellation without refund.
- Event details (time, lineup, venue, pricing) may change. We will make reasonable efforts to communicate material changes via email, SMS, and/or the website.
- Entry may require matching the name on the RSVP / ticket to your ID. Staff may deny entry for intoxication, misconduct, weapons, or violation of house rules.
3. Payments, Pricing & Refunds
Paid tickets and related charges are processed by our payment provider (e.g., Stripe). Prices may include taxes or fees as disclosed at checkout. Unless we expressly state otherwise for a specific event, all sales are final and non-refundable, including for no-shows, late arrival, or denial of entry for policy violations. If an event is canceled by us, we will provide a remedy as communicated for that event (credit, refund, or transfer), subject to processor limitations.
4. SMS / Text Messaging Program (TONE Alerts)
By providing your mobile number and consenting (for example, via checkbox on an RSVP or ticket form), you enroll in the TONE Presents transactional SMS program("TONE Alerts").
PROGRAM DESCRIPTION
You may receive text messages about:
- RSVP confirmation and approval status
- Payment / checkout links to complete a ticket
- QR / entry ticket notices
- Event reminders and entry-related updates
- Customer care replies related to your booking
This program is for transactional / service messages related to your RSVP, ticket, or event attendance—not for unrelated marketing unless you separately consent.
MESSAGE FREQUENCY
Message frequency varies. You typically receive messages when your status changes (for example, approval, payment due, payment received) and may receive limited event-day reminders.
COST
Message and data rates may apply. TONE does not charge a separate fee for SMS; your carrier's plan rates apply.
OPT OUT
Reply STOP to cancel. You may receive one confirmation message. After opting out, you will not receive further SMS from this program unless you opt in again. Opting out of SMS does not cancel your RSVP or ticket; we may continue to contact you by email when needed for the Services.

CONSENT
Consent to receive SMS is not a condition of purchase. Supported carriers vary; delivery is not guaranteed. Carriers are not liable for delayed or undelivered messages.
PRIVACY
Mobile information will not be shared with third parties or affiliates for their marketing or promotional purposes. See our Privacy Policy for how we process phone numbers (including with Brevo for message delivery).
5. Acceptable Use
You agree not to:
- Provide false or misleading information
- Interfere with the Services, scrape without permission, or attempt unauthorized access
- Harass staff, guests, or other users
- Use the Services for any unlawful purpose
6. Intellectual Property
The TONE name, logos, designs, video, and site content are owned by TONE Presents or our licensors. You may not copy, modify, or use them for commercial purposes without prior written permission.
7. Third-Party Services
The Services may link to or integrate third parties (payment processors, messaging providers, maps, social platforms). We are not responsible for third-party terms, privacy practices, or outages.
8. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. We do not warrant uninterrupted or error-free operation, or that SMS/email will always be delivered on time.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TONE PRESENTS AND ITS ORGANIZERS, AFFILIATES, AND VENDORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES OR ATTENDANCE AT EVENTS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO US FOR THE SPECIFIC EVENT GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
10. Indemnity
You agree to defend and indemnify TONE Presents and its organizers against claims arising from your misuse of the Services, violation of these Terms, or violation of any law or third-party right.
11. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Exclusive venue for disputes will be the state or federal courts located in Orange County, California, unless applicable law requires otherwise.
12. Changes
We may update these Terms by posting a revised version with a new "Last updated" date. Material changes to the SMS program will be reflected in these Terms and/or the Privacy Policy. Continued use after changes constitutes acceptance where permitted by law.
